What are they?

The special consultative procedure is established by Local Government Act 2002. Part 6 of that Act sets out the principles for consultation (s82), the special consultative procedure (s83), particular requirements for M?ori (s81), and particular requirements for consultation on the long term council community plan (LTCCP) (s 84) and Annual Plan (s85).

The Special consultative procedure includes requirements to consult over decision to:

  • Transfer the ownership or control of a strategic asset;
  • Construct, replace or abandon a strategic asset;
  • Significantly change the capacity of a local authority.

The provisions require a period of no less than one month to prepare submission in response to a public notice. The public notice is require to set out the summary of decision to be taken and how people may obtain further information.

What role does the special consultative procedure have in marine and coastal management?

The special consultative procedures set out the requirements of how councils should consult over annual plans, LTCCPs and other key documents. Many of these have implications for the coastal and marine environment including coastal and marine management projects, waste treatment facilities, coastal restoration projects, facilities for boating, etc.

What does it mean for me?

Councils are required by the Local Government Act 2002 to encourage your participation in annual plans, long term community plans and other key documents, and at the very least, actively seek your views. This occurs in differing ways around New Zealand but may include street surveys, focus groups, community workshops, open days, information booths and questionnaires. You can check out your local councils’ websites for more information on local Annual Plan, LTCCPs and their content or contact planning staff to register your interest in being involved. You can also talk to your local councillors or get in touch with your residents/ratepayers association if you have one.
